REFLEXÕES SOBRE O CRIME DE FALSO TESTEMUNHO NO BRASIL E NO DIREITO ANGLO-SAXÃO

O presente artigo discorre sobre o tratamento judicial brasileiro da mentira proferida em juízo, com o objetivo de informar e esclarecer especialmente aqueles profissionais que não atuam diretamente com a justiça criminal. Em seguida, aportando estudos e informações sobre o tratamento da mentira nos ordenamentos jurídicos anglo-americanos, reflete sobre semelhanças e diferenças entre esses sistemas e o brasileiro. Por fim, após os insigths proporcionados pelo estudo do direito comparado, o trabalho passa a analisar os incentivos à mentira no direito brasileiro, discutindo as técnicas jurídicas para combatê-la, com especial ênfase na jurisdição trabalhista e abordando questões atuais como as audiências virtuais, com gravação em vídeo.
