A PRÁTICA DAS AUDIÊNCIAS TELEPRESENCIAIS NO BRASIL E NO DIREITO COMPARADO

Resumo

O termo pandemia ingressou no vocabulário popular entre os anos 2020 e 2021 e alterou drasticamente o cotidiano da sociedade, incluindo a dinâmica do Poder Judiciário. As cortes judiciais, no entanto, não poderiam ficar paralisadas: por intermédio da tecnologia e dos meios virtuais de comunicação, manteve sua atuação com uso das audiências telepresenciais. Face à insuficiente normatização sobre o tema, o Conselho Nacional de Justiça editou resoluções sobre a realização de atos virtuais, audiências telepresenciais e por videoconferência. Da mesma forma, o Poder Judiciário estrangeiro adaptou-se, também utilizando os meios telemáticos de comunicação para a realização de atos processuais, inclusive audiências. Os mesmos elogios, percepções, angústias e anseios em relação às audiências virtuais fazem parte do mundo da magistratura em geral, seja no Brasil, seja no direito comparado. Considera-se que as audiências virtuais tendem a permanecer após a pandemia, pondera-se ser necessário adequação concreta e à realidade de cada região, sob pena de ir de encontro ao acesso à justiça. 

The term pandemic entered the popular vocabulary between the years 2020 and 2021 and drastically changed the daily life of society, including the dynamics of the Judiciary. Courts, however, could not remain paralyzed: through technology and virtual means of communication, they maintained their performance using telepresence hearings. In view of the insufficient regulation on the subject, the National Council of Justice issued resolutions on the realization of virtual acts, telepresence and videoconference hearings. Likewise, the foreign judiciary has adapted, also using telematic means of communication to carry out procedural acts, including hearings. The same praise, perceptions, anxieties and anxieties in relation to virtual hearings are part of the world of magistracy in general, whether in Brazil or in comparative law. It is considered that virtual hearings tend to remain after the pandemic, considering that it is necessary to be concretely adapted to the reality of each region, under penalty of going against access to justice.
